When we talk about the rule of law in this country, one principle rises above the rest: the presumption of innocence. Every person accused of a crime is presumed innocent until proven guilty in a court of law. And yet, what we increasingly see in our culture—and online—is a rush to judgment, fueled by outrage and dangerous rhetoric. Take, for example, the sticker making the rounds that says: “Shoot your local pedophile.” At first glance, some people laugh it off or even celebrate it. But let’s be clear—this is not harmless expression. This type of message can easily cross the line into incitement of violence. When we normalize language that calls for execution or mutilation of accused individuals, we are abandoning the very foundation of justice. The problem is compounded by the fact that sex crime allegations, in particular, often lack physical evidence and can come down to one person’s word against another. False accusations are not as rare as many would like to believe. Yet, when someone is accused, the online commentary is often vicious—people posting that the accused should be killed, castrated, or “dealt with” before any evidence has been presented. That kind of mob judgment doesn’t just violate the presumption of innocence—it puts lives, reputations, and families at risk. It creates an environment where an accusation alone can destroy a person long before they have their day in court. As attorneys, we must stand firmly against this. Free speech is a cherished right, but it does not extend to inciting violence. A society that tolerates this type of rhetoric undermines its own legal system and threatens the rights of every individual. Justice requires restraint. Justice requires fairness. And above all, justice requires that we uphold the presumption of innocence—especially when the accusations evoke the strongest emotions.
