Weapons charges

1. Illegal Weapons & Dangerous Weapons

• Class 1 misdemeanor: for possession of illegal weapons (e.g. switchblades, blackjack), punishable by 6–18 months in jail and up to $5,000 in fines

• Class 5 felony: for possession of dangerous weapons (e.g. sawed-off firearms, silencers); first offense carries 1–3 years in prison and up to $100,000 in fines. Repeat offenses escalate to Class 4 felony (2–8 years in prison, up to $500,000 in fines)


2. Unlawfully Carrying a Concealed Weapon

• Class 2 misdemeanor: carrying a firearm or knife concealed without a permit, punishable by 3–12 months in jail and up to $1,000 in fines


3. Prohibited Use of a Weapon

• Class 1 misdemeanor: knowingly pointing a firearm, possessing a weapon while intoxicated, negligently discharging a firearm, or setting traps/devices, punishable by up to 364 days in jail and up to $1,000 in fines.

• Class 5 felony: second offense within 5 years carries 1–3 years in prison and up to $100,000 in fines


4. Possession by a Previous Offender (POWPO)

• Class 6 felony: a first-time offender with a prior felony—up to 18 months in prison, 1 year mandatory parole, and fines up to $100,000.

• Class 5 felony: for those with serious prior offenses (e.g. burglary, arson, or deadly weapon involvement)—up to 3 years in prison, 2 years mandatory parole, and up to $100,000 in fines.

• Class 4 felony: for repeat POWPO convictions—2–6 years in prison, 3 years mandatory parole, and fines up to $500,000
