Q: Should I Let the Police Search My House or Computer?
A: No!! Search warrants can be difficult for the police to obtain, in addition that can be challenged in court. However, if you allow the police to search your home or computer the search will most likely not be challengeable in court. If the police threaten to get a warrant, make them get the warrant before allowing them to search your home and/or computer.

Q: What About Marital Privilege? Can I Talk to My Spouse?
A: Marital Privilege does not apply with Sexual Assaults involving Children, not just your child but, any child.

Q: How Long Can a Probation Sentence Last?
A: Up to the remainder of your Natural Life.

Q: How Long of a Sentence Am I Facing If Convicted?
A: Depending on the severity of the charge you could be facing a possible lifetime prison sentence .

Q: I Plead Guilty. Can I Change My Mind and Withdraw my Plea?
A: Withdrawing your plea after entering guilty is a possibility. You have three years to ask the court to withdraw your plea if the plea was to a felony charge and 18 months on misdemeanors. In order to withdraw your plea you must show that information you received from the Judge, the District Attorney or your Defense Attorney was incorrect.

Q: I Am On Probation Can You Help Me?

Q: Can I Get a Bond?
A: Yes. In most cases you are eligible for a bond pending trial.

Q: How Much Will a Bond Cost Me?
A: Most bondsmen charge between 10-15% of the overall bond amount. Most bonds for sexual assault cases are between $5,000 - $10,000. However, bondmen are businessmen and you can always try to negotiate to a lower percentage, such as 6%. Do not feel pressured to go with the first bondsmen you call. Call multiple bond agencies and inform them that you are doing so; this may result in a better deal for you.

Q: Can I Use Entrapment as A Defense?
A: Entrapment is rarely allowed to be utilized as a defense. Entrapment requires a jury to find an innocent person would have acted in a criminal way under the circumstances. Jurors are reluctant to admit that this could have happened to them, due to the nature of the charges.

Q: Is Sex Offender Treatment, a Big Deal?
A: Sex Offender Treatment is a HUGE DEAL!! Under this treatment you will required to admit to the offense in its entirety, even if it isn't true. Failure to make such an admission is grounds for revocation and will send you to prison . Your treatment providers will monitor all of the relationship you have. This includes sexual relations with your spouse. They will restrict the time you can go into public, as an example you may be required to do your grocery shopping late at night, you may not be allowed to eat out at restaurants and you may not be allowed to attend church.
